Please read these Terms and Conditions (“Terms”) carefully before using the Monomial LLC website https://thinkmonomial.com (“Site”) or its products. By accessing or using this Site, or by purchasing software licenses for software produced by Monomial LLC, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site immediately.
1. ABOUT THIS SITE
This Site is operated by Monomial LLC (“Monomial,” “we,” “us,” or “our”), a Michigan Limited Liability Company, and is intended to provide information about the TraceForge software product. Purchases of TraceForge licenses are conducted through a third-party payment processor linked from this Site. These Terms govern your use of the Site itself; the terms of any purchase are governed separately by the TraceForge Software License Agreement and the third-party payment processor’s terms.
2. INTELLECTUAL PROPERTY
All content on this Site — including text, graphics, logos, product names, and other materials — is the property of Monomial LLC or its licensors and is protected by applicable intellectual property laws. “TraceForge” and “Monomial LLC” are trademarks of Monomial LLC. Nothing in these Terms grants you any right or license to use any trademark, logo, or other proprietary material without the prior written consent of Monomial LLC.
You may view and print pages from the Site for your own personal, non-commercial reference, provided you do not remove or alter any proprietary notices.
3. REFUND POLICY
Full refunds are available upon request at any time prior to the transmission of a license file to the customer. Once a license file has been transmitted, no refund will be issued since Monomial LLC has no mechanism to invalidate a license file and the transaction is considered complete. License holders of record are entitled to request copies of license files up to 12 calendar months after initial purchase or maintenance contract renewal.
To request a refund prior to license file transmission, contact Monomial LLC at support@thinkmonomial.com. Refund requests must include your order information. Refunds will be processed through the original payment method; processing times are subject to the third-party payment processor’s policies.
Nothing in this refund policy limits any rights you may have under applicable consumer protection law in your jurisdiction.
4. THIRD-PARTY PAYMENT PROCESSOR
Purchases of TraceForge licenses are processed by a third-party payment provider. By clicking through to that provider, you will be subject to their terms of service, privacy policy, and other applicable policies. Monomial LLC is not responsible for the practices, availability, or accuracy of any third-party service, and the presence of a link to a third-party provider does not constitute an endorsement by Monomial LLC.
Monomial LLC does not collect, store, or process payment card information directly.
5. THIRD-PARTY LINKS
This Site may contain links to third-party websites for convenience or reference. Monomial LLC has no control over the content, availability, or practices of third-party sites and accepts no responsibility for them. Accessing third-party sites from this Site is at your own risk.
6. PRIVACY AND DATA COLLECTION
Monomial LLC may collect limited data through your use of this Site, including through analytics tools, contact forms, or standard web server logs. Such data may include your IP address, browser type, pages visited, and any information you voluntarily submit.

MONOMIAL LLC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR AVAILABILITY OF THE SITE OR ITS CONTENT, AND EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOUR USE OF THIS SITE IS AT YOUR SOLE RISK.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONOMIAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THIS SITE OR ITS CONTENT. MONOMIAL LLC’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THIS SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS (USD $100.00).
9. ACCEPTABLE USE
You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site. You shall not:
(a) Use the Site to transmit any unlawful, harmful, or objectionable material;
(b) Attempt to gain unauthorized access to any part of the Site or its underlying systems;
(c) Use automated means to scrape, crawl, or harvest content from the Site without prior written consent;
(d) Impersonate Monomial LLC or any other person or entity in connection with the Site.
10. MODIFICATIONS TO THESE TERMS
Monomial LLC reserves the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site with an updated “Last Updated” date. Continued use of the Site following any such change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
11. DISPUTE RESOLUTION
Any dispute arising from your use of this Site or these Terms shall be subject to the dispute resolution and arbitration provisions set forth in the TraceForge Software License Agreement where applicable, or otherwise resolved in accordance with the governing law set forth below, to the fullest extent permitted by applicable local law.
12. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles, except where superseded by the mandatory laws of your jurisdiction.
13. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Monomial LLC and its members, managers, officers, employees, agents, successors, and assigns (collectively, “Indemnified Parties”) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
(a) your access to or use of this Site or any content obtained from it;
(b) your violation of these Terms or any applicable law or regulation;
(c) your infringement of any third-party right, including without limitation any intellectual property right, privacy right, or proprietary right;
(d) any dispute between you and a third party arising from your use of this Site; or
(e) any misrepresentation made by you in connection with your use of this Site or purchase of a TraceForge license.
Monomial LLC reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with Monomial LLC in asserting any available defenses. You shall not settle any claim subject to this indemnification provision without the prior written consent of Monomial LLC.
This indemnification obligation shall survive termination or expiration of these Terms and your cessation of use of the Site.
Nothing in this indemnification clause shall be construed to limit any rights you may have under applicable consumer protection law in your jurisdiction.
